THE 5 ELEMENTS OF FRAUD

Fraud has a number of clear and distinct elements, here are 5 of them I can think of:

❶ There must be at least two parties to a fraud—namely, the fraudster and the party who was defrauded (otherwise known as the victim).

❷ The fraudster must make or facilitate a false representation.

❸ There must be intent by the fraudster that the false representation be acted upon by the victim.

❹ The victim must have the legal right to rely on the representation.

❺ There must be either actual harm or a risk of harm to the victim as a result of the reliance.
